Employee Responsibility
Title 5 of California's Code of Regulations prohibits unlawful discrimination based
on ethnic group identification, national origin, immigration status, religion, age,
sex, gender, gender identification, gender expression, military and veteran status,
marital status, medical condition, race, color, ancestry, sexual orientation, physical
or mental disability.

- Who needs to report unlawful discrimination?
Title 5 requires that any complaints to a Responsible Employee under California law,
shall be forwarded to the responsible district officer or designee. Responsible Employees
are required to disclose all information, including the names of the parties, even
when a party requests anonymity. At Mt. SAC the responsible district officer is Associate
Vice President of Human Resources, Tika Davé-Harris.
According to California Education Code, Responsible Employees are employees who have
the authority to take action to redress unlawful discrimination or provide supportive
measures to students, or who has the duty to report unlawful discrimination to an
appropriate school official who has that authority. At the Mt. SAC that includes:
- Title IX Coordinator or other deputy coordinator(s)
- Classified Managers
- Educational Administrators
- Student life directors, coordinators, or deans
- Athletic directors, coordinators, or deans
- Coaches of any student athletic or academic team or activity
- Faculty and associate faculty, teachers, instructors, or lecturers
- Graduate student instructors, while performing the duties of employment
- Laboratory directors, coordinators, or principal investigators
- Internship or externship directors or coordinators
- Study abroad program directors or coordinators

If someone tells you that they experienced an incident unfair or unequal treatment
because of an an actual or perceived characteristic related to ethnic group identification,
national origin, immigration status, religion, age, sex, gender, gender identification,
gender expression, military and veteran status, marital status, medical condition,
race, color, ancestry, sexual orientation, physical or mental disability, here is how you can help:
- Offer support and encourage them to seek help as soon as possible.
- Provide the person who experienced the incident with a the link to the Human Resources Title 5 web page.
- Health and Safety are the primary concerns:
- If safety is at risk, call Police & Campus Safety at (909) 274-4555.
- If health is at risk call 9-1-1 or call Student Health Services at (909) 274-4400

- “There are many resources available on campus and in the community to help take care of your physical and emotional
well-being.”
- “I can connect you to a confidential resource.”
- “I can connect you with the Deputy Director of Human Resources who can talk to you
about resources, reporting options, and supportive measures.”
- “You have the right to understand all available options and make an informed decision.”
- “I cannot keep this information confidential. I need to forward this information to
someone who can help you and respond. That person will give you information and options
to help you going forward.”

Tika Davé-Harris the college compliance officer, is designated as the responsible
district officer for Mt. San Antonio College. The responsible district officer is
responsible for handling unlawful discrimination complaints under Title 5 of California's
Code of Regulations.
