Complaint Resolution

Mt. San Antonio College has established guidelines for resolving all types of discrimination, harassment, retaliation and sexual violence complaints. There are several early resolution options, depending on the circumstances, including educational programs for targeted campus units or for particular individuals. Where early resolution is unsuccessful or inappropriate, a formal complaint may be filed and a formal investigation undertaken. There is no prescribed sequence, so choosing one option first does not prevent a complainant from choosing a different option for resolution a later time. For complete information on Mt.       Formal Resolution Process

      The process to complete a formal investigation starts with filing a complaint using the Unlawful Discrimination Complaint Form. Upon completion of the form the Title IX Coordinator or his/her designee will receive the form, and if fulfilling the requirements found in the California Code Of Regulations Title 5 § 59328, a formal investigation may be conducted.

      Formal Resolution can occur in one of two situations; when informal resolution is deemed inappropriate or when the complainant submits a formal written complaint. If the formal process is desired or chosen an investigation will begin. The investigation will include interviews conducted with the complainant, the accused, and any other persons who may have relevant knowledge of the complaint. The investigator conducting the interviews will gather and assess all factual information and the context in which the alleged incidents occurred to determine if the alleged conduct constitutes harassment or other unlawful discriminatory conduct. The investigation will conclude with a written report of the findings including a description of the circumstances giving rise to the complaint, a summary of the testimony of each witness, an analysis of any relevant data or other evidence collected during the investigation, a specific finding as to whether discrimination did or did not occur with respect to each allegation in the complaint, and any other appropriate information.

      After completing the written report Mt. San Antonio College will provide the complainant and accused with an administrative determination that includes a summary of the investigative report within ninety days from the date the College received the complaint. The complainant and accused shall also be provided with a written notice setting forth the determination of the Title IX Coordinator or his/her designee, as to whether harassment or other discriminatory conduct did or did not occur with respect to each allegation in the complaint; a description of action taken, if any, to prevent similar problems from occurring in the future; the proposed resolution of the complaint; and notice of the complainant’s rights to appeal to the College's Board of Trustees and the Chancellor’s Office of the California Community Colleges. The results of the investigation and the determination as to whether harassment or other discriminatory conduct occurred shall also be reported to the accused, and the appropriate academic or administrative official(s). Reports to the complainant shall be prepared so as not to violate any applicable privacy rights of the accused.

    • Informal Resolution Process

      Outcomes of an informal resolution may include:

      • Rearrangement of Work or Academic Schedules
      • Obtaining Apologies
      • Providing Informal Counseling
      • Providing Informal Training

      Upon receiving notification of a harassment or discrimination complaint, the Title IX Coordinator, or his/her designee, shall undertake efforts to informally resolve the charges. In addition, to an informal resolution the complainant may also choose to file a complaint leading to a formal investigation. During the process of a formal investigation the efforts for an informal resolution may continue.

Reporting Concerns or Complaints

Because complaints of discrimination, harassment (including sexual misconduct), and sexual violence are most effectively addressed at the earliest possible stage, Mt. San Antonio College encourages early reporting of concerns or complaints regarding harassment. If you believe you have been harassed, you are encouraged to discuss your options and to learn about Mt. San Antonio College procedures by contacting (909) 274-4225. You may obtain advice without filing a complaint. Unreasonable delay in reporting harassment or failure to utilize Mt. San Antonio College’s complaint resolution procedures may affect your legal rights.
A number of governmental agencies also accept complaints of discrimination and harassment, including the California Department of Fair Employment and Housing (related to employment); the US Equal Employment Opportunity Commission (related to employment); and the Office for Civil Rights, US Department of Education (related to student complaints). 

    • Sexual Misconduct
      Reports of sexual misconduct may be made to Human Resources, the Mt. San Antonio College the Department of Police and Campus Safety Department, the Office of Student Life, Student Health Services, and other campus resources outlined in the Mt. San Antonio Sexual Assaults on Campus Administrative Procedure. Investigations of reports of sexual misconduct are conducted by the Department of Police and Campus Safety in collaboration with the Title IX Coordinator. Sexual misconduct can be addressed through the District’s administrative procedures and through the criminal justice system. Any criminal proceeding is entirely separate from administrative proceedings of the District.

    • Unions (Exclusive Representatives)
